The wonderful Prof. Stefan Homburg (Link) summed up the last two days of the trial on X. We couldn't have summed it up better:
Process day #5 on November 12th, 2024 - turning point in the Ballweg process
On the 5th day of the trial yesterday, it emerged that Michael Ballweg had not made a profit from the fundamental rights demonstrations, but had suffered losses. Court and public prosecutor Dr. Franziska Gräfe appeared shocked.
Background:
The only
witness that day was a government director from the Karlsruhe Regional
Finance Directorate with 30 years of service experience. He came with
his own lawyer (!), which led to questions.
In terms of content, the witness described the procedure as unusual and even unique. He expressed anger at having been cut off from information at some point and denied all responsibility for the nine-month pre-trial detention.
But the real bombshell didn't explode until later: Apparently the public prosecutor didn't know that Michael had filed a tax return after his release from prison. She wanted even less to know the losses listed therein. Your current indictment is based on fabricated six-figure winnings that were never properly determined.
This day of the trial also confirmed the impression of a thoroughly political trial: someone who dared to demonstrate against lockdowns should be jailed at all costs in order to deter others.
Process day #6 on November 12th, 2024 - Trouble with the tax office
Many people are familiar with problems with the tax office. But what happened to @Michael_Ballweg is unique. The tax officer responsible for him testified today.
She rejected the extension of time he requested from prison and kept the criminal proceedings alive.
Background: The highly nervous tax officer was responsible for Michael Ballweg's income tax at the Stuttgart tax office. She did not notice that he did not submit his declaration on August 31, 2022 because his documents were confiscated and he was in prison. Such missed deadlines trigger an automated dunning process, a common occurrence.
When his request for an extension of time was received, the officer saw on the screen that a manhunt was underway. During the trial, she correctly stated that she could grant the application, even retroactively.
A decision without errors of discretion could only take the form of extending the deadline due to the impossibility of submission. Instead, she rejected the application after consulting with the investigator. This is unbelievable because the search department has no authority to give instructions to the case handlers.
The investigator was obviously politically motivated and was intended to escalate the criminal proceedings. He had already participated in the search, seizure and arrest in June 2022, although at that time, according to all officials, there was no tax crime. The authorities brought about the crime themselves through arrest and rejection of the application.
In my opinion, there is strong suspicion of the persecution of innocent people, at least against this tax officer, the investigator and the public prosecutor, Section 344 of the Criminal Code.
